Is the character "Captain Jack Sparrow" under copyright?

Hey fellow pirates!

Well... the title says it all. I'm currently searching for information about the fictional character "Jack Sparrow" and copyright. I'm planning in doing shows as an entertainer (as well as many others already do Very Happy ) and I'd like to know beforehand if later on Disney may come over and sue me for using this very special fictional character.

Disney has full legal rights to pursue yes. So most "change the name" to something a "near miss" aka Pirate Captain or Swashbuckler Jack etc.

They probably won't come after you with a C&D so just don't make too big a splash or make too much money.

The best research you can do is google search other impersonators and see how they market themselves

I did some research and studied the works of other impersonators. Most of them use the name Jack Sparrow in one way or another and do explicitly sell their services. The point is: I'm planning on making an online series. The exact theme is not sure yet, but it will be starring me as Jack Sparrow in the main role. ^^

IF Disney would have something against that, I don't know if it would help to call myself Captain Jack Sarrow for example in the series and look as much like him, as I will be able. The point still comes across (and of course should): That's an impersonation of Jack Sparrow. Wink

It's just, that this character is soooo much fun to play and I have experienced, that I can bring lots of joy to other people doing the Jack. Therefore I don't see any evil in doing it (at least partly) for a living. It wouldn't be nice on the other hand, to earn something through this, live a happy little life and get sued afterwards by Disney. xD

I dont think any of us have ever heard of an impersonator getting sued. But I know if you hire a impersonator to come to your party - Jedi Knights are called "Space Warriors" Darth Vader is called "Space Villain" Disney princes are refereed to generically and Jack is always "pirate captain" or close facsimile.

Disney sued a Florida couple for 1 Million Dollars for using their character likenesses.

A Copyright covers the specific look of a Character..... A Trademark covers the name of the Character (Mickey Mouse, Donald Duck, Jack Sparrow...ect.)
Both can be infringed upon and both can be sued for.
